Terms & Conditions

Your Health:

Client has sought medical advice and is declared fit to exercise by a Doctor or Physiotherapist or is participating in exercise against medical advice entirely at their own risk.

Client agrees to honestly disclose anything which may affect their ability to exercise, including but not limited to: any pre-existing injury or medical conditions either awaiting or undergoing diagnosis or treatment; any use, cessation or changes to any medication prescribed or un-prescribed, legal or illegal; general health changes; dietary limitations.

Client understands that participation in exercise is voluntary and they can, at any time during a session, request to stop or reduce the exercise.

Client MUST make the trainer aware of any of the following if experienced before, during or after exercise: dizziness; fatigue, shortness of breath, chest pain or discomfort, muscle or joint pain.

Client MUST seek medical attention if they experience anything because of point 1 or 2 or if they experience anything listed under point 4. Failure to do so is at their own risk.

Client understands that the trainer is not a medical professional so is not able to diagnose or suggest treatment for injury or medical conditions.

Client understands there will be a certain amount of physical contact between them and the trainer to ensure use of correct technique.
-
Client understands that failure to disclose under points 2 & 4, puts them at risk of further injury or worsening of any medical conditions for which they are fully responsible and liable.

Client understands that Nexus Physiques Limited does not advise or diagnose for anything outside our scope of practice.

Client understands that the trainer has the right to refuse or stop an exercise session for any reasons including but not limited to points 1; 2; 4 & 5.

Client may be asked to leave the premises if they are deemed to be disruptive or aggressive or under the influence of any substances.

If client fails to disclose any medical conditions/injuries before signing the agreement, we do not accept responsibility or liability.

If the client becomes unwell they must notify the trainer as soon as possible to determine whether they are healthy to partake in physical activity.
-
If the client sustains an injury outside of the training sessions or undergoes surgery and is unable to attend sessions the outcome is at the discretion of the Director.
Payment & Cancellations:

In the scenario where a duplicate payment is made, if requested we can either subtract the amount from an upcoming month or process a refund as soon as possible.

Payments are usually collected via Direct Debit, Bank Transfer.
-
Payments are usually collected for the upcoming month between the 24th - 1st (For example 24/01 - 01/02). If your pay schedule sits outside of these parameters then an alternative payment date will be set.
-
If you are paying bi-weekly, we will agree on which dates the payments and total amount are to be completed by.
-
Pay as you go clients are required pay for two sessions upfront and then top up for each completed session (see cancellation policy section 4).

If payment is not made by the 1st of the month or the agreed payment date without informing us, you may be unable to book PT sessions and risk forfeiting your regular time slot until payment is made. App access may also be frozen.

We ask that you give 30 days notice to cancel any packages, any payments due within this time frame are expected as usual.

In the event you are terminating Personal Training, app access will be revoked at the end of the notice period regardless of any remaining sessions.

In the event that you need to pause Personal Training for one month. To have continued app access without charge, we ask that you give 30 days notice to maintain access to your programme during the frozen period

Pay as you go clients are required to give two sessions notice to cancel the PT Agreement.

If you decide after signing the agreement that you do not want to go ahead with our service, any previous charges up to that point remain.

Upon termination of this agreement. If you decide to return in the future you may be subject to new pricing.
PT/ Online Sessions and Bookings:

Client is responsible for booking their gym sessions using the booking link provided.
-
Sessions must be paid for prior to booking them.
-
If the trainer needs to cancel a booking within the 24 hour window, your session will not be lost and will be rescheduled.
-
If the Trainer is unable to deliver sessions in person for a period of time (due to sickness or injury) alternatively these can be delivered online or we will arrange additional bookings to catch up with any missed session upon the trainers return.

If the Trainer decides you are unhealthy to exercise the session will be stopped. We ask that you respect their decision and the remaining session time will be rearranged at the trainer's discretion.

PT Sessions will expire if not used within one month of the package expiry date.
-
We ask that the client is ready to start on time for their session, however if they are more then 15 mins (30 min session), 25 mins (45 min session) or 30+ mins (60 min session) late to the session it will count as a no show.
My PT Hub/ Nexus App:

Is only available for active/paying clients (PT Packages or Programmes).
-
Access will be revoked at the end of a notice period or if a payment deadline is not met.
-
Programme only members are to use the message function within the app to contact us for support.
-
An App only membership is the minimum requirement to use our app unless gifted with a trial period.
-
Any unpaid users will be notified before their access is revoked.

Holidays & Sickness:
​

Pricing have my holidays taken into account to allow myself at least four full weeks off per calendar year. During this time the client will follow the programme provided by the trainer.
-
If I am away on leave for one week, a minimum of one session will be forfeited and not be made up at a future date. This is due to having to play catch up with too many sessions from the holiday week. However if less than one week is taken off (the odd day or two), and sessions are missed as a result of this, we will simply reschedule.

In the occurrence of absence for a client for example: holidays, illness (trainer or client)). Session will be made up by the end of the following month, dependent on the availability of the client.

In the event that the client is unable to attend sessions due to long term illness or injury, any uncompleted sessions will be added upon your return.
-
If I am on holiday or off duty for any other reason, responses to phone calls, message/ e-mails will be delayed until my return.

Purchased Programmes:
​

These solo programmes are pre-designed and tailored towards a specific goal.
-
There are no additional one to ones or personalisation of the programme with this option.
-
The client is responsible for monitoring their own progress such as: taking measurements, uploading progress pictures, tracking workouts and nutrition in the app provided.
-
We will only offer advice on programmes, any additional work (training or nutrition related) or PT sessions will come at an additional cost.
-
If there are any errors in programme start date or missing information, we will amend this at no additional cost.

Purchased Offers:

Must be started within 7 days of purchasing, unless a different date has been agreed.
-
Any sessions included must be completed within the given time frame. For example: 6 weeks of sessions and programming are to be completed within 6 weeks of the start date.

NEXUS PHYSIQUES LIMITED policy:
​

We do not accept responsibility or liability of any Injury or Medical condition for those who do not follow our professional advice.

We provide a progress hub, training and/or nutrition plans through software (My PT Hub, Microsoft Programmes etc)
-
Any session plans we provide to our clients are not intended for the use of any other person.
-
If the client becomes inactive (no longer a paying client) app access is revoked.
-
All information created in the app by us (all workouts and all nutrition information) are the intellectual property of Nexus Physiques Limited and are not to be replicated for the use of others.
-
We reserve the right to terminate this agreement if any part is not adhered to by the client.
-
We take four weeks off per calendar year to allow the trainer to have a break. This time is needed to recover and avoid burnout. Any sessions during our this time period are lost.

Any additional time off work we

We provide any necessary information in advance (such as session plans) should the trainer take time off for holiday.
GENERAL DATA PROTECTION REGULATION (2018):

Any information that you provide us with is not shared or sold on to any other person or organisation without your consent unless required to do so by law enforcement.

Your information will only be shared upon request if you need to be referred to another professional.
-
Information gathered is stored on a password protected device/ cloud server and/ or a secured filing cabinet.

Please be aware that you have the right to have all your information erased and be ‘forgotten’ from our database.
-
Appearing on our social media or marketing promos is not compulsory and you have the right to refuse being portrayed as such.

The Client:

agrees to adhere to our Terms & Conditions.
-
agrees to be up to date on payments before attending PT Sessions.
-
agrees to commit to do their part by following the programme and advice set by the trainer to maximise their results.
-
agrees to notify the trainer immediately if they become unwell. Showing up to a session unable to complete it may result in the session being cancelled.
-
agrees to be pro-active, willing to learn and make necessary lifestyle changes.
-
agrees to attend the gym or partake in physical activity at a moderate to vigorous intensity at the recommended amount of times each week.
-
agrees to take note of the session dates and times in their calendar.
-
agrees to log all of their progress on the My PT Hub/ Nexus app (workouts, measurements, habits, nutrition and progress pictures). Failure to do so will forfeit the right to any type of reimbursement.

agrees to give 24 hours notice to reschedule an appointment otherwise the session may be lost (these will only be rearranged at the trainers discretion).

agrees to arrive 10 minutes early before each session to ensure they are properly warmed up for the start time or in some cases be ready to be trained for a specific part of the workout.

agrees to cool down efficiently post workout following the trainer’s advice.

agrees that if they arrive too late of the session start time, the session may be cancelled and not redeemed.

agrees that if sessions can not be delivered in person, an online delivery will be provided as an alternative.

agrees to allow the Trainer time off for holiday and during that time will follow the programme provided in place of PT sessions.
